Bane got banned for this last push.
When I made Will's gang aware of it, this is what they had to say:
08:58am Boganlord gossips: you realize bane got banned for that last push?
08:59am Ozrinom gossips: nobody's getting banned this push;) cleary right?
09:01am Shadow gossips: better get on your speed dial then
So basically they know it is a bannable offense but they're doing it anyways because they don't think anyone is going to show up to ban him.
Bane shouldn't have been banned for it last push, and Will shouldn't be banned for it in this one. This is working as was intended. This exact scenario was mentioned when alternative interactions were discussed. This isn't how I'd like it to work, but it is how it works; intentionally, not a bug.
